Abstract (English):

The article deals with the issues of mastering the achievements of the Muslim legal culture and their compatibility with the general principles of the Kazakh legal system. The author singles out the religious and legal factor in the development of the legal system in Kazakhstan. The goal of the research is to define the degree of social justifiability of the introduction of the Muslim school is and to what extent these institutions contribute to the improvement of the existing law in Kazakhstan. The research uses a cross-cultural approach. The study of the process of cultural and religious revival and its influence on the Kazakhstani system of law is necessary for the systematization of objective knowledge of the Muslim law. As a summing up, the article notes that the introduction of the norms regulating the activities of the Islamic Bank into the Law of the Republic of Kazakhstan «On Banks and Banking Activity» proves that the legal norms of the Muslim school has been included in the current regulatory and legal framework of Kazakhstan. The readiness of the state to implement religious norms testifies that the legal institutions of the Islamic law are socially justified and contribute to the improvement of the existing law in Kazakhstan.
